　　本书是第四届全国高校法律英语大赛论文比赛优秀论文集。全书共收论文82篇，主要涉及法理学、宪法学、行政法学、刑事法学、刑事诉讼法学、民商法学、知识产权法学、国际法学和外国法学等。因此，根据论文的主题，本论文集分为五个部分：

Legal Basis of the Delegation of Certain Military LegislativePower The Legislation Law authorizes the People' s Congress and its StandingCommittee of provincial, autonomous regions, municipalities directly under theCentral Government and major city level power to promulgate local regulationsand their administrative branch rules within statutory region. ( Article 63 andArticle 72 ) The law also emphasizes that the content of such rules andregulations should lie within the authority of its maker, and at the same timecorresponds with the spirit of laws and administrative regulations promulgated byNational People' s Congress and State Council. According to Article 107 of theConstitution, local people' s government above county level are entitled to"administrate the economic, educational, scientific, cultural, hygiene, gymnastic,urban and rural construction, fiscal, people' s affair, public security, ethnic,judiciafia, family planning work, and other related work by making decisions andissuing orders. " Though no direct reference of the word "national defense" in plaintext, it ispartial to say the least if we are to exclude national defense from the localgovernment's built-in functions. According to Law of People' s Republic ofChina on National Defense, the definition of "national defense activity" consistsof not only military campaign, but also paramilitary activities including relatedpolitical, economical, scientific, and even educational affairs. These paramilitaryactivities are, to a great extent, within the responsibility of the government' silministration spectrum, and therefore should be classified as the government' snational defense responsibilities. When discussing whether local governmentsshould have military legislative power, we should draw our attention to theduality of this particular power, keeping in mind that it consists of two parts, viz. aational defense legislation and legislation in the army. "National defenselegislation refers specially to the making of national defense laws and regulationsby legislature of state (the National People' s Congress and its standingcommittee) and state government agency (the State Council), while legislationin the army refers to authorized military institutions' activity of issuing militaryrules and regulations. " As a result, military legislative power can be dividedcorrespondingly into two parts--army legislative power and national defenselegislative power.
